Terms of Service

By accessing or using the Lotapay Technologies website at lotapaytechnologies.co.zw (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

Lotapay Technologies is a technology company providing custom software development, IT equipment sourcing, and related technology services. We operate primarily in Zimbabwe and across Africa.

You agree to use the Site only for lawful purposes and in a manner that:

• Does not infringe the rights of any third party.
• Does not transmit any unsolicited commercial communications (spam).
• Does not attempt to gain unauthorised access to any part of the Site or our systems.
• Does not interfere with the normal operation of the Site.

We reserve the right to suspend or restrict access to the Site for any user who violates these Terms.

All content on the Site, including but not limited to text, graphics, logos, icons, images, code samples, and layout, is the property of Lotapay Technologies or its licensors and is protected by applicable copyright, trade mark, and other intellectual property laws.

You may view, download, and print content from the Site for your own personal, non-commercial use, provided you do not modify the content and retain all copyright and other proprietary notices.

You may not reproduce, distribute, display, transmit, or otherwise exploit any content from the Site for commercial purposes without our prior written consent.

Software and code delivered to you as part of a custom development engagement will have intellectual property terms set out in the relevant project agreement. Unless otherwise agreed in writing, all intellectual property created by Lotapay Technologies under a project agreement remains our property until full payment has been received.

The Site may contain links to third-party websites or services that are not operated by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policy of any third-party site you visit.

The Site and its content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or currency of any information on the Site.

To the fullest extent permitted by applicable law, Lotapay Technologies and its directors, employees, agents, and partners shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or its content.
• Loss of profits, revenue, data, business opportunities, or goodwill.
• Damages arising from errors, omissions, interruptions, or delays in the Site or services.

Our total liability to you for any claim arising from or related to these Terms or your use of the Site shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or USD 100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the fullest extent permitted by law.

These Terms are governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
